Beyond License Plate Award Program - Official Rules

THIS PROGRAM IS INTENDED FOR PARTICIPATION IN THE 48 CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA AND CANADA (EXCLUDING QUEBEC) ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE OR LOCATED OUTSIDE THE UNITED STATES AND THE DISTRICT OF COLUMBIA OR CANADA (EXCLUDING QUEBEC) AT THE TIME OF ENTRY.

ELIGIBILITY: The Looking Beyond the License Plate Program (the “Program”) is open only to legal residents of the 48 contiguous U.S. States and the District of Columbia and Canada (excluding Quebec) who are the age of majority in their state/province/territory of residence and are duly sworn law enforcement officers in good standing. Program is not open to the general public. Void in Quebec and where prohibited by law. Employees, officers, directors and agents of Sponsor, 3M Traffic Safety & Security Division, (“Sponsor”), 3M Company, Gage Marketing Group LLC, and their respective parent companies, affiliates, subsidiaries, and advertising/promotional agencies, and members of the immediate family or persons living in the same household of such individuals, are ineligible to participate or win an Award. Subject to all federal, state, local and provincial laws. All eligible individuals as defined herein are referred to as “Entrant”.

HOW TO ENTER: Beginning on January 1, 2016 at 12:00:01 a.m. Eastern Standard Time (“EST”) through 11:59:59 p.m. EST on May 15, 2016 (“Program Period”), a prospective Entrant may enter the Program by visiting http://www.iacp.org/LookingBeyondtheLicensePlateAwardProgram and following the entry instructions. Entrants must: A) complete the entry form with all required information, which will include first name, middle initial and last name, Rank, Police Department Name, City and State. B) Complete the Incident Logistics, Your Story and Agency Head Information sections (“Entry”). C) Check the box indicating you have read, accept, and agree to be bound by the Official Rules. Entries must be based on license plate observations occurring during the Program Period. Entries that do not comply with the requirements specified in these Official Rules will be disqualified. Limit one (1) entry per person. Once an Entry is submitted, it may not be edited or resubmitted. No correspondence regarding the screening or verification of Entries will be undertaken by the International Association of Chiefs of Police (IACP), except as specified in these Official Rules.

ADDITIONAL ENTRY REQUIREMENTS:
 

• Stories contained in entries must be suitable for republication, as determined in IACP’s sole discretion.
• Entries conform to these Official Rules and IACP and its agents, in their sole discretion, may disqualify your Entry for any reason at any time, including if it determines, in their sole discretion, that your Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by IACP, in its sole discretion.
• Released Parties (as defined below) are not responsible for any unauthorized use of republished Entries by third parties.

PROGRAM EVALUATION: On or about June 1, 2016, an independent, qualified panel of evaluators will evaluate all eligible Entries received based on the following criteria:
 

• Methods and Tools Used (10%) – Level of personal observation, tools and technology such as ALPR or Mobile computing device (MCD).
• Investigation (40%) – The level of investigative work involved.
• Resulting Community Benefit (40%) - Resulting benefit to community, law enforcement, public and highway safety; element(s) of danger or risk to officer(s), citizens and crime victims; details of how officer recognized danger, took effective steps to reduce risks to law enforcement personnel, crime victims, and citizens.
• Thoroughness of Entry (10%) - Thoroughness of submitted entry (e.g., simply stating "See attached report" in lieu of completing each section.) Attachments are encouraged, but concise descriptions are required.

The Entrant submitting the Entry receiving the top score will be declared the potential Top Honors Award recipient, subject to verification. The Entrants submitting the four (4) Entries with the next highest scores will be declared potential Honorable Mention winners, subject to verification. In the event of a tie, tie will be broken based upon the highest score for Technology and continuing thereafter in each category until the tie is broken.

The evaluators’ decisions on all matters pertaining to evaluating, administering and agency.

AWARD DESCRIPTIONS AND APPROXIMATE RETAIL VALUES (“ARV”):
One (1) Top Honors Award recipient - a trip for winner and one (1) guest to the 2016 IACP Conference. Trip includes round trip coach airfare from a major airport near winner’s residence for winner and guest to 2016 IACP Conference location, 3 nights/4 days at IACP-specified hotel (one room, double occupancy), admission for two (2) into the Conference and a $500 travel stipend (taxis, food, etc.). ARV: $4,500 USD. Actual retail value will depend on airfare fluctuations and winner's point of departure/return. Any difference between stated approximate retail value and actual value of the Award will not be awarded. If Top Honors Award recipient elects to travel without a guest, no additional compensation will be awarded in lieu thereof. All other travel-related expenses, including but not limited to meals, luggage fees, gratuities and incidental hotel and personal expenses are the sole responsibility of the winner. Winner and guest must travel on the same itinerary. IACP reserves the right, in its sole discretion, to offer any or all of the forgoing awards to the Top Honors Award recipient’s agency instead of offering them to the Top Honors Award recipient, or to withhold award of any or all of the awards, if necessary to comply with the ethics rules of the recipient’s agency. The agency may designate an eligible person to use an award in accordance with agency policies, and any such designated person will be subject to these rules as if the designated person was a “Winner.” Accommodations are subject to availability and certain restrictions and blackout dates may apply. Once trip is booked, any changes made at winner’s request are at winner’s expense. If the potential Top Honors Award recipient lives within 150 miles of the 2016 IACP Conference location, the recipient will be reimbursed the actual cost of travel by car or other ground transportation, not to exceed $300, in lieu of airfare.

Four (4) Honorable Mention Awards – The agency of each Honorable mention Award recipient will be offered one (1) free Admission into the 2016 IACP Conference. ARV: $500 USD. Honorable Mention Award does not include transportation to, or accommodations for the Conference. The agency may designate any eligible person to use the free Admission by notifying the IACP. No other transfer, cash redemption or substitution of an award is permitted, except by IACP, who reserves the right, in its sole discretion, to substitute award of equal or greater value.

GENERAL: Winners are responsible for payment of any income taxes on Award under applicable federal, state, local and provincial laws. All federal, state, and local taxes and other expenses not specified herein are the sole responsibility of the winner. Potential Top Honors Award recipient and his/her guest will be required to sign and return a Release of Liability Form, within 10 days of notification. In the event of non-compliance with these requirements, award may be forfeited. In the event that an award or award notification is returned as undeliverable, such award will be forfeited and an alternate will be determined by the next highest scoring Honorable Mention winner, at the IACP’s sole discretion.

By participating, Entrants release IACP, its officers, directors, employees, members, attorneys, agents, servants, contractors, chapters, and affiliates (“Released Parties”), from any and all liability with respect to participation in the Program or the acceptance or use (or misuse) of any award or any use of the Entry submitted by Entrant. Entrants agree to release, defend, indemnify and hold harmless Released Parties from and against, and accept all responsibility of any kind, including but not limited to financial, for any liability, claims, losses, damages or proceedings, including but not limited for death, (including reasonable attorneys' fees) relating to any actions taken by entrants, including without limitation all warranties relating to participation and entry in the Program and use of entrant’s e-mail or other identification purporting to act on entrant’s behalf in regard to the Program (whether or not such use occurred with or without your permission). Entrants also agree to release, defend, indemnify and hold harmless the Released Parties from any and all liability, claims, losses, damages or proceedings, including but not limited for death (including reasonable attorneys' fees) relating to Program award consideration and Program publicity, and any other matter in connection with entrants’ participation in the Program. By entering/winning an award, you agree that IACP is granted a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions, including the names embodied therein, in whole or in part, on a worldwide basis, (including websites and social media platforms), and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes.

Released Parties are not responsible for lost, late, damaged, delayed, or incomplete Entries, Entries not received by entry deadline, interrupted or unavailable network, server or other connections, mis-communications, failed telephone, computer hardware, software and other technical failures of any kind, including injury or damage to any person's computer relating to or resulting from participating in or experiencing any materials in connection with the Program, unauthorized human intervention, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online regardless of cause that may limit a user's ability to participate in the Program. IACP reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these official rules. INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, IACP RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. IACP reserves the right to cancel or modify Program if fraud, misconduct or technical failures compromise the integrity or fairness of the promotion; or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Program as determined by IACP/evaluating agency/administrator, in their sole discretion. In the event of cancellation, a notice will be posted online, entries received prior to termination will be evaluated and Awards determined from among all eligible, non-suspect entries received prior to the cancellation. In the event of a dispute regarding the identity of the person submitting an online entry, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access Provider, online service provider, or other organization (e.g., business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. IACP may require proof to its satisfaction of entrant’s registered subscriber status. Multiple entrants are not permitted to share the same email address. Any attempt by an entrant to obtain more than one (1) entry by using multiple/different email addresses or any other methods will void that entrant’s entries and that entrant may be disqualified.

Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Program shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Virginia or the appropriate Virginia State Court located in Alexandria, Virginia; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Program but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and/or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Program, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia.

Residents of Canada, please note: Participation in the Program implies consent to transfer personal data to the United States for purposes of administration of the Program and consent for personal information to be transmitted, stored and processed in jurisdictions outside of Canada that may not have the same protections as Canada. Personal information may be used to: (A) contact Entrants regarding the Program; (B) publish an Entrant’s name in a Winners List, if they should win; and (C) if an Entrant selects to receive additional information, to send additional information to that Entrant. Entrants have the right to access, withdraw and correct their personal data.
